Terms and Conditions of Sale

1.    Live Free or Die Antique Tool Auctions has the right and absolute discretion to refuse admission to the premises or attendance at the auction by any person.

2.    Live Free or Die Antique Tool Auctions has the right and absolute discretion to refuse any bid, to advance the bidding as it may decide, to withdraw or divide any lot, to combine any two or more lots and, in the case of a dispute, to put up any lot for auction again.

3.    The buyer shall be the highest bidder accepted to Live Free or Die Antique Tool Auctions and Live Free or Die Auctions shall have absolute discretion to settle any dispute.

4.    Every bidder shall register, giving name and address, providing identification if required by Live Free or Die Antique Tool Auctions before making any bid at the auction.

5.    Each registered bidder will receive a bid number to be recorded alongside his registration details.

6.    Any representation or statement by Live Free or Die Antique Tool Auctions in the auction listing or other publication, including the online catalogue of the sale, as to the origin, manufacturer, date, age, size, medium, provenance, condition or estimated selling price, of any lot is a statement of opinion only. Any illustrations on the internet site (www.mjdtools.com/auction/auction.htm) are solely for guidance and are not relied upon in terms of color or necessarily to reveal any imperfections in any lot.

7.    References given to damage and/or restoration are given as guidance only and the absence of such a reference does not imply that a lot is free from defects, nor does the reference to particular defects imply the absence of others.

8.    Buyers must satisfy themselves as to the matters referred to in conditions No.’s 6 and 7 above by inspection or otherwise prior to the time and date of the auction.

9.    The Buyer shall pay to Live Free or Die Antique Tool Auctions a premium of 10% of the hammer price and the buyer acknowledges that Live Free or Die Antique Tool Auctions may also receive commission from the seller.

10.  The property in a lot shall not pass to the buyer until payment has been made in full.

11.  Methods of payment are cash or check.

12.  Checks should be made payable to Live Free or Die Antique Tool Auctions.

13.  The Buyer shall not be entitled to claim under any guarantee for an amount more than the amount paid by him for the lot and in par-ticular shall have no claim for any loss, consequential loss or damagewhether direct or indirect suffered by him.

14.  Live Free or Die Antique Tool Auctions offer a confidential sales service acting as the agent for the seller, and under no circumstance are obliged to offer information regarding the Seller’s identity.

15.  The seller of electrical or mechanical goods warrants and undertakes to Live Free or Die Antique Tool Auctions and to the Buyer that at the date of consigning the same are safe and if reasonably used for the purpose for which they were designed and free from any defect not obvious on external inspection which could prove dangerous to human life or health, and will indemnify Live Free or Die Antique Tool Auctions and its employees against any loss or damage suffered by any of them in consequence of any breach of the above warranty and undertaking.

16. The Seller warrants to Live Free or Die Antique Tool Auctions and to the Buyer that he has and will be able to transfer good and mar-ketable title to the lot free from all third party rights and claims.
